Buyer Beware

TrustedWatch-Buyer Beware protects your purchases conducted at TrustedWatch.biz up to 10,000.00 Euro. For this protection to be effective, as a buyer you are required to register your Buyer Beware application directly by TrustedWatch prior to conclusion of the purchase agreement and payment of the item.

TrustedWatch processes every application within 2 business days and will send you a confirmation of the insurance protection per email. In addition, the email will also include your individual insurance code.

Attention: You purchase is only insured once you have received your insurance code.

Before receiving the insurance code, please do not conclude a purchase agreement and do not submit any payments to the seller!

Insurance Conditions

1. General

TrustedWatch-Buyer Beware protects the buyer if a purchased item has not been shipped or a supplied item significantly differs from the item description of the seller (see also Clause 4).

In the event of damages or loss, TrustedWatch will check the process and if required, requests further information from the buyer and seller to gain clarification.

2. Disbursement

If a TrustedWatch-Buyer Beware application is successful, TrustedWatch shall reimburse the buyer with the purchase price including shipping costs. If payment is made in a currency other than Euro, the reimbursement will also occur in that currency. Disbursement occurs regardless as to whether TrustedWatch can request the reimbursement amount back from the seller or not.

3. Entitlement of Benefits / Obligations of the Buyer

To take advantage of TrustedWatch-Buyer Beware, the following conditions must be fulfilled:

  • 3.1 The buyer has purchased the item via TrustedWatch.biz
  • 3.2 The application for Buyer Beware was sent and confirmed prior to conclusion of the purchase agreement.
  • 3.3 The buyer has access to the insurance code indicated in the confirmation email.
  • 3.4 The buyer reports the event of damage or loss no later than within 30 days after receipt of the insurance code.
  • 3.5 The buyer is required to answer all inquiries concerning the application on TrustedWatch-Buyer Beware within ten days. TrustedWatch will reject this application, if there is no answer within the given period.
  • 3.6 If the buyer applies for TrustedWatch-Buyer Beware because the received item significantly differs from the item description of the seller, the buyer is required in certain cases to return the item to the seller at the cost of the buyer and present an appropriate delivery receipt. In addition, TrustedWatch reserves the right to request further documents to support the claim of the buyer. The buyer is responsible for possible costs he may incur.
4. Which cases are protected?

TrustedWatch-Buyer Beware applies to the following cases:

  • 4.1 The paid item was not shipped by the seller.

    TrustedWatch-Buyer Beware does not apply to items lost during the shipping process. If the seller presents a valid shipping receipt, TrustedWatch-Buyer Beware is excluded.

    Before filing an application for TrustedWatch-Buyer Beware, the buyer is required to grant the seller a sufficient period of time for shipping and initially try to clarify the matter by directly contacting the seller.

  • 4.2 The delivered item significantly differs from the item description of the seller.

    Please find below several examples of where an item differs significantly from the item description.

    The following list is inconclusive.

    • a. The item is completely different to the one described in the item description.
    • b. The condition of the supplied item significantly differs from the described condition. For example, it is apparent that the item has been used frequently as opposed to being new and still in its original packaging.
    • c. The item cannot be used which was however not described in the item description. For example, essential components or parts or the item do not work.
    • d. The item is not authentic. For example, it is an imitation or a pirate copy.

    TrustedWatch decides in each individual case and based on appropriate evidence whether the item actually differs from the item description. This decision and with that also the decision for the application on TrustedWatch-Buyer Beware is final. The judges‘ decision towards TrustedWatch regarding this decision is final.

  • 4.3 Only one application on TrustedWatch-Buyer Beware per buyer respectively is admissible. Any subsequent application can only be submitted once a previous application has been completely finalised.

5. Final Clause
  • 5.1 With the receipt of the disbursement of TrustedWatch-Buyer Beware, the buyer assigns all claims existing towards the seller from the application on TrustedWatch-Buyer Beware underlying the purchase agreement in the amount of the payout amount to TrustedWatch.
  • 5.2 TrustedWatch reserves the right to change or cancel TrustedWatch-Buyer Beware at any time at their own discretion and without having to indicate any reasons. Pending claims at the time of cancellation will continue to be processed until a final decision has been made.
  • 5.3 The buyer allows TrustedWatch to refer to shipping information of the respective shipping company in his name to check the shipping status of an item.
  • 5.4 These insurance conditions do not affect the legal rights of the buyer. TrustedWatch will not act as a representative of the buyer or seller. TrustedWatch only decides on the application for TrustedWatch Buyer Beware.
  • 5.5 If one of the provisions of these conditions become invalid, the validity of the remaining provisions is unaffected. The parties are obligated to agree upon a legally valid and workable provision in the place of a legally invalid or unworkable provision which most closely approaches the intended legally valid and workable provision.
